Introduction.
This website is owned and operated by Zolio LLC. We at Zolio respect your privacy. This Privacy Policy explains the ways in which we may collect, use, or disclose personal information and the options that you have regarding such collection, use or disclosure.
By using www.Zolio.com, you agree to the terms and conditions of this Privacy Policy. This Privacy Policy is also incorporated into the Terms of Use for the Zolio site. By accessing or using the Zolio site, you agree to accept those Terms of Use. If you do not agree to the terms and conditions of this policy, please do not use the Site. We reserve the right to change this policy without prior notice. Any changes to our Privacy Policy will become effective upon our posting of the revised policy on this website. Use of the Site following such changes constitutes your acceptance of the revised Privacy Policy then in effect.
The Site is controlled and operated by Zolio from the United States, and is not intended to subject Zolio to the laws or jurisdiction of any state, country or territory other than that of the United States. Please note that the Zolio site contains links to other websites. This Privacy Policy does not apply to the practices of sites other than the Zolio site, and we suggest you review the privacy polices associated with those sites and contact the owners of those sites if you have questions regarding their information practices. Zolio does not represent or warrant that the Site, or any part thereof, is appropriate or available for use in any particular jurisdiction. Those who choose to access the Site do so on their own initiative and at their own risk and are responsible for complying with all local laws, rules and regulations. We may limit the Site’s availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and at our sole discretion.
By using our Site you are consenting to our processing of your information. “Processing” means using information in any way, including, but not limited to, the use of cookies, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the U.S. your information will be transferred to the U.S., and processed and stored there under U.S. privacy standards.
Personally Identifiable Information (“PII”) Collected by Zolio.
“Personally Identifiable Information” (or “PII”) is that information which can be used to identify you as an individual or to contact you. You do not have to provide PII to access the Site. However, in order to set up your own Zolio™, we require you to provide certain minimal PII. Our registration form requires you to give us information such as your name, email address and password. In addition, we reserve the right to use the information we collect about your computer, which may at times be able to identify you, for any lawful business purpose, including without limitation to help diagnose problems with our servers, to gather broad demographic information, and to otherwise administer our Site.
You may always choose not to provide PII. However, this may limit our ability to provide you with a specific service or particular content. In order for you to take advantage of particular opportunities provided through Zolio.com, you may be required to furnish additional PII. Such additional information might include your postal address, profession, industry and resume information including: contact information, career summary, career objective, work history, educational history, skills, certifications, clearances, references, as well as any portfolio information you may want to attach in your Zolio™ such as written documents, video or audio clips, photographs, charts, and external links to PII you wish to reference. All such information is voluntarily provided to us by you.
We may collect demographic and other data, which may include PII. This information is provided by you, and you have the choice whether or not to input information about yourself. Demographic information is divided into two categories: 1) “non-public information”, which consists of personal or financial information and one-on-one communications between you and other users of the Site; and 2) “public information”, which consists of all other demographic information. Do not enter non-public information into your “Profile.”
If you choose to build a Profile you will be required to register with the PII indicated above. You will also be able to enter information regarding your skills, experience and interests that will allow partner companies to search for people like you. By default, your Profile will be public and available to companies and other users who are directed to your Zolio. Zolio may use your Profile information to match you to various job opportunities or users. Once presented with the opportunity, you can choose whether to make contact with the matched user(s) or act on the job opportunity.
YOU POST USER CONTENT ON THE SITE AT YOUR OWN RISK. Please be aware that no security measure is perfect or impenetrable. We cannot control the actions of other users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that user content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of user content may remain viewable in cached and archived pages or if other users have copied or stored your user content.
Personally Identifiable Information Collected by Zolio’s Business Partners:
Zolio works with employers, third-party advertising companies, sponsors and other companies with whom we do business (”Business Partners”) to provide
our registered users with the greatest number of employment opportunities possible and provide you with place advertising that may be of interest to you. Information about your visit to the Site, such as number of times you have viewed an ad, may be used to serve these purposes.
Zolio may correlate or match registered user information, including PII, with information held by our Business Partners to target ads or otherwise improve the effectiveness of our service. Our Business Partners may read or set cookies on your hard drive, use pixel tags, track which ads you have viewed, or collect other information about you. Business Partners may also search for complementary characteristics within your Zolio to facilitate ideal job placement.
In some cases, we may enter into a relationship with a Business Partner in order to provide users with the greatest benefit of a Zolio. Companies who agree to accept a Zolio in place of a resume may use your personal information in accordance with their own hiring, employment, privacy and other policies.
Zolio makes reasonable efforts to communicate the privacy preferences in your account settings to such Business Partners, but we cannot guarantee that they will comply with your preferences. You will need to contact the Business Partner to instruct them directly regarding your preferences for the use of your personal information by them. Additionally, you agree that Zolio may use and disclose all such information so submitted to such Business Partners in the same manner in which we are entitled to use and disclose any other information you submit to us.
Zolio disclaims all liability for the privacy policies and procedures on any Business Partner Web site.
Non-Personally Identifiable Information (Non-PII).
When you visit and interact with the Site, Zolio and third parties with whom Zolio has contracted to provide services to Zolio may collect Non-PII. Non-PII is generally collected through the Site from different sources such as server log files, environmental variables, cookies, pixel tags and other similar technologies and information that you voluntarily provide.
We have areas on the Zolio site where you can submit feedback. Any feedback you submit in these areas becomes our property, and we can use such feedback (such as success stories) for marketing purposes or to contact you for further information.
Information Uses.
We may use your PII in some or all of the following ways:
· Fulfillment of Requests: Zolio may use your PII to fulfill the purpose for which such PII was provided (for example to fulfill your purchase, build a profile, have your education credentials certified or have a career management professional review your Zolio).
· Administrative Communications: We may use your PII to send you important information regarding the Site, or changes to our terms, conditions, and policies. Because this information may be important to your use of the Site, you may not opt-out of receiving such communications.
· Marketing Communications: If you affirmatively opt-in, we may use your PII to inform you of products and services that we believe may be of interest to you.
· Interests: If you choose to do so, you may receive messages from other Site users relating to certain areas of interest that you select. We do not provide your PII to such other users—rather, the message from the user is sent to a group of people, including you, based on demographic information and the areas of interest you and the others in the group have selected, and you can decide whether to respond to the message or delete it.
· Internal Business Purposes: We may also use your PII for our internal business purposes, such as data analysis, audits, order fulfillment tracking, enhancing our web site, improving our services and identifying usage trends.
Use of Personally Identifiable Information by Other Users.
Other users, specifically Business Partners, will be able to view the information that you provide on your Profile. Other Users may choose to contact you. When using the process on the Site, it is up to you to choose when you are comfortable disclosing your email address, or any other contact information, to others through private communications. Individual users can choose the contact information that you are willing to place on the public profile, thereby controlling the means by which interested companies or other users can contact you.
Business Partners, participating companies, and other users will have access to any information that you choose to display in your Profile. All materials must be your own. Zolio is not responsible for the mishandling or mislabeling of any documents uploaded onto a profile.
PLEASE NOTE: The privacy practices of advertisers and other companies who provide services or advertising through our Site are not covered by this Privacy Policy. Please contact those companies directly for more information about their privacy practices. If you wish to prevent those companies from setting cookies on your browser, you may set your browser to refuse cookies or to warn you before setting a cookie. Disabling cookies set by companies whose products or services are advertised on this Site may affect your ability to use this Site.
While your personally identifying information is protected as outlined above, we reserve the right to use, transfer, and share aggregated, anonymous data about our users as a group for any business purpose, such as analyzing usage trends and seeking compatible advertisers and partners.
Information Sharing and Disclosure.
Service Providers: We engage certain third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management, and direct marketing campaigns. We will share your PII with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring such third parties to maintain the privacy and security of your data.
Compliance with Laws and Law Enforcement: Zolio cooperates with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims, legal process (including subpoenas), to protect the property and rights of Zolio or a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.
Business Transfers: Zolio may sell, transfer or otherwise share some or all of its assets, including your PII, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. .
Personnel: Our personnel (including, for the avoidance of doubt, consultants and/or contractors) may have access to user information while carrying out their duties in the normal course of our company business.
Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. You hereby consent to our sharing of your personal information for the above purposes.
Other Uses of Information - We also share aggregated anonymous information about visitors to Zolio (for example, the number of visitors to Zolio) with its clients, Business Partners and other third parties so that they can understand the kinds of visitors to the Zolio site and how those visitors use the Zolio site. We may also aggregate on an anonymous basis data regarding job qualifications, schooling, age, experience level or other information relevant to the job search or competition among seekers for any such job. Such data may be made available to employers or fellow job seekers.
Changing or Deactivating a Zolio Account.
Individuals who wish to deactivate their Zolio account may do so. Removed information may persist in backup or cached copies for a reasonable period of time but will not be generally available to any user of Zolio
Opt-Out: As noted above, if you expressly opt-in, we may send you marketing-related email messages. Additionally, as noted above, if you expressly opt-in, we may share your PII with third parties for their marketing purposes. If, after you have opted in, you change your mind and you no longer wish to receive marketing-related emails from us and/or you do not want us to share your email address with third parties for such third parties’ marketing purposes, you may opt-out of receiving such marketing-related emails and/or from such sharing.
Please note that if you opt-out as described above, we will not be able to remove your PII from the databases of third parties with which we have already shared your PII (i.e., to which we have already provided your PII as of the date that we implement your opt-out request). If you wish to cease receiving marketing-related emails from such third parties, please contact such third parties directly or utilize any opt-out mechanisms set forth in their respective privacy policies or marketing-related emails.
If you close your Zolio account, we will remove your name and other PII from our publicly viewable data. We may retain certain data contributed by you if it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained data will continue to be subject to the terms of the Zolio Privacy Policy that you have previously agreed to.
Altering Previously Provided Information.
Changing or Removing Your PII: If you would like to review, correct, update or remove PII that you have previously provided to us through the Site, you may do so. Please note that we may need to retain certain information for recordkeeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed. We also reserve the right, from time to time, to re-contact former users of the Site. Finally, we are not responsible for removing information from the databases of third parties with whom we have already shared your PII.
Security.
Disclosure: This Site has industry standard security measures in place to protect the loss, misuse and integrity of the information under our control. Although we make good faith efforts to store the information collected in a secure operating environment that is not available to the public, we cannot guarantee complete security. You acknowledge that you provide your personal information at your own risk.
Breach of Security: Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us. We will make any legally-required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement or any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
Our Policy Towards Children and Young Adults.
Children Under Age 13: Zolio does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for Zolio or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on Zolio. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us.
Young Adults Between the Ages of 13 and 18: We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet.
Advertising and Promtoions.
Promotions: We reserve the right to share PII you provide in connection with advertising and promotions of third-party sponsors of such promotions (irrespective of whether such promotions are hosted by us), or otherwise in accordance with the rules applicable to such promotion. You should carefully review the rules, if any, of each promotion in which you participate through the Site, as they may contain additional important information about a sponsor’s or other third parties’ use of your PII. To the extent that the terms and conditions of such rules concerning the treatment of your PII conflict with this Policy, the terms and conditions of such rules shall control.
Forums.
Zolio may make available services such as message boards and listservs (among other services) to which you are able to post information and materials (each, a “Forum”). Please note that the Forums may be provided by a third-party forum service, and not by us, and thus, the use of your PII by the third-party forum service will be governed by such third party’s privacy policy, not this Policy. Please note that any information you disclose through a Forum becomes public information and may be available to visitors to the Site and to the general public. When you choose to make a posting on such services, certain PII (such as your user name) will be available for other users to view. We urge you to exercise discretion and caution when deciding to disclose your PII, or any other information, through a Forum. WE ARE NOT RESPONSIBLE FOR THE USE OF ANY PII YOU VOLUNTARILY DISCLOSE THROUGH A FORUM.
Law Enforcement; Emergencies; Compliance:
Notwithstanding any other provision of this Policy to the contrary, we reserve the right to disclose your PII to others as we believe to be appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to governmental requests; (d) to enforce our Terms of Service; (e) to protect our operations; (f) to protect the rights, privacy, safety or property of Zolio, you or others; and (g) to permit us to pursue available remedies or limit the damages that we may sustain.
